AutoNews® Website Terms and Conditions:

The AutoNews® website is a media portal service provided by Polk Australia Pty Ltd (Polk) for the purpose of facilitating the placement by members of the Australian automotive industry of press releases and related information for access by the Australian media. AutoNews® is a secure site and may contain sensitive information that is not available to the public generally. Access to AutoNews® is therefore restricted to persons who have been granted access and issued with a login ID and password by Polk. Only persons having, in Polk's opinion, a legitimate interest in or connection with the Australian media (as may be evidenced by membership to a recognised press association such as the Australia Press Council or a Country Press Association) will be granted access to the site. Polk may deny access to the site to any person in its absolute discretion. Applications for access to AutoNews® may be made by contacting Polk at info@autonews.com.au Polk may, in assessing your application, require any documentation that it considers necessary to verify whether you have a legitimate interest in or connection to the Australian media which, by applying for access to the site, you warrant that you have. In applying for access to AutoNews®, you may be required to provide Polk with personal information. You must read the terms of Polk's privacy policy before applying for access to the site. When you are granted access to AutoNews®, you will be given a non-transferable login ID and a password to access the site. You must not allow any other person to use your login ID and password or otherwise access the site. You are responsible for maintaining the confidentiality of your login ID and password and are responsible for any unauthorised access to the site occurring under your login ID and password. If at any time you forget or misplace your login ID or password, please contact us at info@autonews.com.au and we will issue you with a new login ID and password. You must not do anything which alters the site, or interferes with or affects its working. This includes removing anything from it, adding anything to it, linking it to or from another website, and distributing any part of it to anyone else. By accessing AutoNews®, you agree to be bound by these conditions of use. Polk is entitled at its sole discretion to change, amend, add to or remove any part of these conditions of use at any time without notice. Your continued use of the site constitutes an agreement by you to abide by and be bound by these conditions of use, as so amended. Polk may change, amend or delete any features of AutoNews®, and may Polk may suspend or terminate the provision of the site at any time and for any reason without notice. All material on AutoNews® including the site design, text, graphics, logos, photos, images, typefaces (and their selection and arrangement) and all software implementing the site is protected by copyright under the laws of Australia and, through international treaties, other countries. Polk is the owner or licensee of all copyright in the site and is the licensee of copyright in the press information displayed on or directly accessible through the site. Subject to these conditions of use, Polk grants you a limited non-transferable licence or sub-licence to view, download, use, adapt, reproduce in material or electronic form, publish and communicate to the public, any press information displayed on or directly accessible through AutoNews® only for the purpose of providing reporting services to the Australian public through a recognised media publication, and for no other purpose. For the avoidance of doubt, a publication having as a primary purpose advertising, marketing or promotion will not constitute a media publication. All rights not expressly granted are reserved. Any unauthorised use of the information displayed on or accessible through the site may violate copyright, trade mark and other applicable laws and could result in criminal or civil penalties. Polk does not warrant that the information displayed on or accessible through AutoNews® does or will not infringe the intellectual property rights of third parties, is or will be accurate, suitable for your purposes or without errors, omissions or viruses nor does Polk guarantee continuous, uninterrupted or secure access to the site. Polk does not warrant the accuracy of any advice, opinion, statement, representation or other information displayed on or accessible through AutoNews®. Subject to the provisions of the Trade Practices Act 1974, Polk makes no representations or warranties in respect of the information and materials available on AutoNews® or the means of accessing that information and material (including the software operating in connection with the site). Polk makes no warranty or representation and accepts no responsibility for any websites operated or controlled by entities other than Polk which are or may become linked or framed to or from the site. You agree that Polk is not liable to you or anyone else for any loss or damage (including, without limitation, any direct, indirect, special or consequential loss) arising out of, or in connection, with the use of AutoNews® or for any such loss or damage which may arise should you be unable to access the site for whatever reason and however arising, including (without limitation) negligence. You indemnify Polk against any action, liability, claim, loss, damage, proceeding, expense (including legal costs) suffered or incurred by Polk, arising from, or which is directly or indirectly related to, a breach or non-observance of any of these terms and conditions by you, a breach of any warranty given by you to Polk, or a false or misleading representation made by you to Polk. If you breach any provision of these conditions of access or use, Polk may immediately issue a warning, temporarily suspend or permanently prevent your access to all or certain parts of AutoNews®. In any event, Polk may terminate these terms of use (and your right to use the site) at any time and for any reason without prior notice to you. These conditions of use, and the agreement of which they form part, is to be governed by the laws of the State of Victoria, Australia. Polk has designed AutoNews® for use only within the Commonwealth of Australia and makes no warranties or representations with regard to use by persons accessing, downloading or otherwise using the sire outside the Commonwealth of Australia.
